Am I at liberty to remove this tree ? ?

The Horse Chestnut tree has grown very large since we moved here in 2011. There is a very real danger of its roots damaging the below ground services to nos. 10,11 & 12 River Lane. There doesn't appear to be a TPO on the tree. Am I at liberty to have it removed by a professional and a smaller tree planted to replace it ? The reason I am asking is that on your map the area is shown coloured grey indicating that you may consider this as an area of your responsibility.
